Terms of Service

1. Introduction

Welcome to Minekube AI ("Company", "we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of our AI-powered Minecraft server management platform ("Service"). By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

Beta Service: Minekube AI is currently in beta and invite-only. The Service may contain errors, bugs, or other issues. We reserve the right to modify, suspend, or discontinue the Service at any time during the beta period.

2. Eligibility and Account Registration

Invite-Only Access: Access to the Service requires a valid referral code from an existing user. You must be at least 13 years old to use the Service. If you are under 18, you represent that you have your parent's or guardian's permission to use the Service.

Account Creation: To access the Service, you must create an account using Discord OAuth. You agree to:

  • Provide accurate, complete, and current information during registration
  • Maintain and update your account information to keep it accurate
  • Maintain the security of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

3. Referral System

Free Access: During the beta period, access to the Service is provided free of charge through our referral system. Each referral grants you 1 week of free access to the Service.

Referral Terms:

  • You may share your referral code with others to extend your access
  • Each person who signs up using your referral code grants you an additional 1 week of free access
  • Referral codes are personal and non-transferable
  • We reserve the right to modify, suspend, or terminate the referral system at any time
  • Abuse of the referral system (including creating fake accounts or using multiple accounts) may result in termination of your access

4. Use of Service

License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use during the beta period.

Permitted Uses: You may use the Service to:

  • Create and manage Minecraft servers through natural language conversation
  • Generate plugins, scripts, and server configurations using our AI
  • Manage players, server settings, and game rules
  • Share server templates and configurations (subject to Section 5)

Prohibited Uses: You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Violate Minecraft's Terms of Service or End User License Agreement
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use the Service to create content that is harmful, abusive, discriminatory, or violates others' rights
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity
  • Use automated systems (bots, scrapers) to access the Service without our written permission
  • Share your account credentials with others
  • Use the Service to create servers that distribute malware, engage in phishing, or other malicious activities

5. User-Generated Content and AI-Generated Content

Your Content: You retain ownership of any content you create or upload to the Service, including server configurations, plugins, scripts, and world data ("Your Content").

License to Us: By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify, and display Your Content solely for the purpose of providing and improving the Service.

AI-Generated Content: Content generated by our AI (including plugins, scripts, and configurations) is provided "as is" without warranty. You are responsible for reviewing and testing all AI-generated content before deploying it to your server. We are not liable for any damage, loss, or issues caused by AI-generated content.

Content Responsibility: You are solely responsible for Your Content and any content generated through the Service. You represent and warrant that Your Content does not violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights.

6. Service Availability and Modifications

Beta Service: The Service is provided "as is" and "as available" during the beta period. We do not guarantee that the Service will be available at all times or that it will be error-free. We may perform maintenance, updates, or modifications that temporarily interrupt service availability.

Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Data Retention: During the beta period, we may delete or reset server data, configurations, or other content at any time. We recommend backing up important data. We are not responsible for any loss of data.

7. Payment Terms

Current Pricing: During the beta period, access to the Service is provided free of charge through our referral system.

Future Pricing: We reserve the right to introduce paid plans or pricing changes in the future. We will provide at least 30 days' notice before implementing any paid plans or significant pricing changes.

Payment Processing: If and when paid plans are introduced, payments will be processed through third-party payment processors (e.g., Stripe). By providing payment information, you authorize us to charge the applicable fees to your payment method.

8. Termination

Termination by You: You may stop using the Service at any time by deleting your account.

Termination by Us: We may suspend or terminate your access to the Service immediately, without prior notice, if you:

  • Violate these Terms or any applicable laws
  • Engage in fraudulent, abusive, or illegal activity
  • Abuse the referral system or create multiple accounts
  • Use the Service in a manner that harms us, other users, or third parties
  • Fail to comply with any of your obligations under these Terms

Effect of Termination: Upon termination, your right to use the Service will cease immediately. We may delete your account, server data, and all associated content. We are not obligated to retain or provide you with any data after termination.

9. Intellectual Property

Our Property: The Service, including all software, technology, designs, text, graphics, logos, and other content, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

Minecraft: Minekube AI is not affiliated with, endorsed by, or associated with Mojang Studios or Microsoft. Minecraft is a trademark of Mojang Studios. All references to Minecraft are for descriptive purposes only.

10. Disclaimers and Limitation of Liability

No Warranties: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

AI Limitations: Our AI may generate incorrect, incomplete, or inappropriate content. You are responsible for reviewing and testing all AI-generated content. We are not liable for any damage, loss, or issues caused by AI-generated content or AI actions.

Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, MINEKUBE AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Maximum Liability: Our total liability to you for any claims arising out of or related to the Service shall not exceed the amount you paid us (if any) in the 12 months preceding the claim, or $100, whichever is greater.

11. Indemnification

You agree to indemnify, defend, and hold harmless Minekube AI, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any rights of another party.

12. Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law principles.

Jurisdiction: For any disputes arising out of or in connection with these Terms, the courts of Germany shall have exclusive jurisdiction, except where mandatory consumer protection laws require otherwise.

Consumer Rights: If you are a consumer (as defined under German law), you may also be entitled to the protection of mandatory provisions of the law of your country of residence. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions.

Informal Resolution: Before filing a claim, you agree to contact us to attempt to resolve the dispute informally. We will attempt to resolve the dispute within 30 days.

Online Dispute Resolution: The European Commission provides a platform for online dispute resolution (ODR), which you can access at https://ec.europa.eu/consumers/odr. We are not obligated to participate in ODR proceedings.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on this page and updating the "Last Updated" date. Your continued use of the Service after such changes constitutes your acceptance of the modified Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and Minekube AI regarding the Service and supersede all prior agreements and understandings.
